Freedom of Information

The Freedom of Information Act 1991 serves to promote openness and transparency in governance and accountability of government agencies, including councils.

To achieve these objectives, it confers on members of the public a legally enforceable right to be given access to documents. The Freedom of Information Act 1991 sets out the legislative requirements for how applications for access to information held by the Council are to be dealt with. Some documents may be exempt from public release under the provisions of the Act.

A person may request personal information held by Council to be released to them and can also request amendments to documents if they are incomplete, incorrect, misleading or out of date.

Many Council documents do not require a Freedom of Information application and are available on Councils website. A list of these documents are contained in our Freedom of Information Statement and include:

  • Minutes and Agendas
  • Policies and Procedures adopted by the Council
  • Strategic management plans
  • Annual Reports
  • By-Laws
  • Registers,
  • Development applications under the public consultation.

To access documents not publicly available on Council’s website or listed in the Freedom of Information Statement, then a written Freedom of Information request can be made using a prescribed form and accompanied with the initial application fee of $40.75.

Associated fees apply to the processing an FOI application as provided in the Freedom of Information (fees & charges) Regulations 2003. The initial fee of $40.75 must accompany the lodgement of the completed Freedom of Information (FOI) Request application form (concession card holders and pensioners are exempt of this fee).

In order to reduce the fees associated with this process it is advisable to contact the Council's Freedom of Information Officer to discuss the specifics of the request on 08 8828 1200.
